If an employee accesses pornography at work, they can be lawfully dismissed if the employer has clearly outlined that such behaviour is prohibited.Prior to any final action being taken, the employer must follow due process and ensure there is an investigation of the circumstances surrounding the incident. They are also required to provide the
employee with a fair opportunity to respond.
Employers should clearly state what unacceptable behavior includes, and outline their policy in writing. They may opt to send internal memos, individual letters, as a section in an employee handbook, or as part of the employment contract.
